Full -scale war - not ATO: why today the military cannot retire before

The military can retire at any age by serving 25 calendar years. This term is reduced if the service was held in "hot spots". But so far, these norms do not apply to the defenders who are now on the front. Recently, the People's Deputy Galina Tretyakov has published information about how many military pensioners live in Ukraine. It turned out that there are 367 644 such people in our country. Those who are younger than 60 years - 177 thousand 181.

Of these, 156 thousand are not in military service or do not work at all. Military pensioners are persons who receive a pension under the provisions of the Law of Ukraine "On Pension Support of Persons Dismissed from Military Service and Some Other Persons". These include those who receive a pension for years of service and in connection with disabilities.

According to the lawyer of the NGO "Legal Hundred" Irina Dmitrenko, you can retire for years of service at any age after dismissal from service if there are at least 25 years of calendar. Or if there are 25 years of insurance experience, of which 12. 5 years - service in security structures, you can retire at 45 years.

"It is important that not only the military service, but also the service in the police, judicial protection, civil protection authorities, the State Criminal Enforcement Service, the time of work in state bodies in the event of transition to military service to the power service belongs to the years of service. structures, as well as the time of study in universities, if at the end of the training the officer (special) title, " - says Focus Dmitrenko.

The amount of the retirement pension depends on the amount of cash received during the service and service. By law, the performance of works related to the elimination of the consequences of the Chernobyl accident, participation in the Ukrainian peacekeeping mission in Iraq, the time of participation in the ATO/OOS is counting as one month in three months.

There are also periods that are taken into account as one month of service in two months of service-it is to stay on flight work in jet and turboprop aviation, in the positions of divers, the time of service in some departments of military hospitals and forensic institutions.

Staying in positions where the performance of duties is related to systematic parachute jumps, service in special purpose units of the Security Service of Ukraine, the Ministry of Internal Affairs and NSU, in zones of unconditional (mandatory) and guaranteed voluntary resettlement, in the positions of sappers, entitles to calculation service as one month of service in a month and a half.

"During the legal regime of martial law, the period of participation in hostilities is not considered preferential calculation, since there is no indication in the legislation. There is currently a law in parliament, designed to remedy this situation. stay in captivity. The bill is not considered by the Verkhovna Rada, " - adds Dmitrenko. With regard to the amount of the pension, in the presence of 20 years of service the pensioner receives 50% of the amount of cash.

For more than 20 years - additionally plus 3% for each year. If a person has retired due to the age or health, the pension is 55% of cash. "The law, of course, determines the minimum and maximum amount of years of service. The pension may not be less than the subsistence level for persons who have lost their capacity and higher than 70% of cash," the lawyer said. For the liquidators of the Chernobyl accident, the maximum amount is set by 100%.

With regard to a disability pension, two conditions are important for obtaining it: the presence of disability related to the performance of military service or with military service, and dismissal. The age of a person who claims this type of pension does not matter because disability can occur at any age. The amount of disability pension, as well as the retirement pensions, depends on the amount of cash and is 100% for persons with disabilities as a result of group I war I.

The second and third groups are entitled to 80% and 60%, respectively. Other persons with disabilities of group I are entitled to 70%, II - 60%, group III - 40%of the relevant amounts of cash. Both types of pensions include the establishment of allowances and surcharges. For example, an allowance for the maintenance of disabled family members in the amount of 50% of the subsistence minimum for persons who have lost their ability to work for each person.
