Russian agents - to access to Russia: on what conditions Ukraine is ready to give collaborators

Ukraine suggested that Russia collaborators and traitors to exchange them for civilian hostages captured in occupation. Why this idea in the SBU and GUR is considered good, and human rights activists oppose the focus. Oleksandr Pashchenko is a killer who acted with special cruelty. It is called since 2012, when the sentence of the Rubizhansk city court of Luhansk region has come into force.

Pashchenko has been punished-life imprisonment-in the correctional colony # 31 of the Novgorod-Siversky Chernihiv region, and has been staying for 14 years. Pashchenko met a full -scale invasion of Pashchenko. Despite the partial occupation of the Chernihiv region, Novgorod-Siversky was not under the control of the Russian army, and all prisoners were in the institution, hiding from shelling. The attack of the Russian Federation in March 2022 was felt.

However, as it turned out, not everyone agreed that Russia was an aggressor country. Among the skeptics - Alexander Pashchenko. As it became known to the investigation, in early September 2022, in the presence of several convicts, he publicly denied the implementation of armed aggression of the Russian Federation against Ukraine and publicly called for support for the decisions and actions of the aggressor country.

"Russia helps Donbass and releases the territory enthusiastic of Ukraine," "the war in Ukraine has resolved the political leadership of Ukraine, bending under the countries of the collective event," he said, what was said in the sentence. In addition, from his flash card launched videos of Russian TV programs about conducting the so-called special military operation, the "release" of the peoples of the so-called. "DNR" and "LNR", creation of "Novorossiysk".

For this, he was simply charged with collaborative activity (part 1 of Article 111-1 of the Criminal Code of Ukraine), and sentenced, in addition to lifelong, for another ten years of imprisonment. Pashchenko pleaded fully. And in June 2024, the photos and personal data of Alexander Pashchenko appeared on the site "I want to do" along with several dozens of similar.

All these people were convicted of collaboration, treason or transmitting information to the enemy, and wrote a statement with a request to transfer them to the Russian Federation. It may be enough to soon get a chance for freedom, if this opportunity was not even considered. "She loved more," - this is how the Russian Federation spoke during the court hearing Angelina Dovbnya. In October 2023, a 21-year-old girl was sentenced to state treason.

The court found that the young person was photographed and filmed electrical substations, military objects. In particular, she marked on the map of the location of the checkpoints near the Kremenchug oil refinery, recorded a video near the Russians destroyed by the Russians of the shopping center "Amstor" in Kremenchug. Viktor Shestakov also agree to the Russian Federation.

He was sentenced to 15 years in prison for treason in the conditions of martial law and justifying the armed aggression of the Russian Federation against Ukraine. Shestakov headed a number of pro -Russian organizations, and was also an authorized person from PPP (Putin's Policy Party). He was preparing anti -Ukrainian publications that discredited Ukraine's defense forces, justified aggression.

For example, he denied rocket strokes at the Kremenchug, apartment building in the Dnieper and Kyiv's energy facilities. Since the beginning of a full -scale invasion of the Security of Ukraine, the Security Service of Ukraine has opened more than nine thousand criminal proceedings on collaborative activity and awards of the Russian Federation, at least a thousand citizens of Ukraine have already been convicted.

"With regard to betrayal, this is 111 of the Criminal Code - more than 2,800 criminal proceedings have been opened. There are almost 550 persons. The SBU also opened almost 500 criminal proceedings on unauthorized dissemination of information about the Armed Forces, these are the so -called corrections. More than 120 people have been sentenced, ”says SBU spokesman Artem Dekhtyarenko during a public event in Kiev. All convicts - potential participants in the project "I want to do".

This is a joint initiative of the Coordination Staff on the management of prisoners of war, the Main Directorate of Intelligence of the Ministry of Defense, the Security Service of Ukraine and the Secretariat of the Ombudsman. All these structures are convinced that it is important in the context of the return of the detainees of the Russian Federation of Ukrainians, and for many hostages it is an additional opportunity to be freedom.

In other words, it is a proposal to exchange citizens of Ukraine with Russia. "From the name we understand that it is about people who consider not Ukraine, not European democratic values, our state and the constitution, but the aggressor state-the Russian Federation, and want to get there. Data on such persons, by their voluntary written consent, They will be published on a special site, " - said the representative of the Main Directorate of Intelligence of the Ministry of Defense Andriy Yusov.

Data is a photo of convicts, brief information about them and "consent to the exchange", that is, the request of a person for its transfer to the territory of the Russian Federation or a temporarily occupied territory of Ukraine as a prisoner of war "for exchange for a citizen of Ukraine in captivity of the Russian Federation". The SBU says that about 500 Ukrainians have already been given the consent of the exchange, 200 of them agreed to publish their data on a special site.

According to the Commissioner of the Verkhovna Rada of Ukraine for Human Rights, the return of persons will be carried out by preliminary coordination with the Russian colleague Tatiana Moskalkova. That is, in fact, Ukraine has officially spoke for the first time from the beginning of a full -scale invasion of the Ukrainian side to exchange civilians with the Russian side. Human rights activists are opposed to such an initiative.

Among them is the Director for Advocacy of the Zmina Human Rights Center Alona Lunova. She says: searching for "no need" "scum", photos of which can be exhibited on the site, their "voluntary" consent to exchange with home addresses - this is not just a violation of international law and in general the concept of human rights, it is a crime .

"I know for sure that public authorities have long and systematically working to find a mechanism for the return of civilians illegally detained in the Russian Federation, in compliance with international law. It is because what this mechanism will be important. Citizens of Ukraine from different parts of the country and illegally held civilians in the Russian Federation creates many risks that need to be taken into account, "she explains focus.

First, the seizure of civilians and their maintenance and movement is a war crime. And this crime is systemic and mass. Only by the calculations of human rights defenders, at least 1770 people - hostages of the Russian Federation were recorded. And this figure is only approximate, it grows due to the long occupation of part of the territory of Ukraine. And the prospect of sharing civilians can cause a new wave of detentions and the formation of a "exchange fund".

Secondly, civilian exchange is impossible-neither the military nor on civilians. This should be the requirement of unconditional release. "Leaving the issue of ethics of" wrong Ukrainians "for" right Ukrainians ", stimulating civilian exchange of civilians is unlikely Problems and complications for Ukraine, ”says Lunova. The lawyer, an expert of the media initiative for human rights from international humanitarian, criminal law and human rights Andriy Yakovlev, also agrees with it.

"The transfer of citizens of Ukraine under the control of the Russian Federation will testify that Ukraine does not recognize prisoners for collaboration as its citizens. This is close before we suddenly abandon our citizens who are forced to find ourselves in the occupied territory," he explains.

The lawyer reminds that in general, Ukrainian laws on counteracting collaborationism are too strict, as they do not take into account the peculiarities of the occupation regime and the conditions of the Russian Federation created. It allows you to hold a very wide range of citizens. Ukraine has not yet been able to harmonize collaborative laws with international law, as other countries have done before. Nowadays, there are significant risks.

One of them is to stimulate the law enforcement and judicial system of Ukraine to violations, superficial investigation and consideration of relevant cases. In addition, the accused persons may occur at the stage of pre -trial investigation before the guilt and the conclusion of the agreement in exchange for potential dismissal in the future.

For example, the already mentioned Angelina did not file an appeal for the sentence, but immediately asked to add it to the lists for exchange between Ukraine and Russia. Obviously, she was promised that they would contribute to the transfer to the Russian Federation if she pleads guilty.

"At the same time, the state of the state is understood that among the convicts for collaboration actions there are such Ukrainian citizens who do not identify with Ukraine and give up Ukrainian identity," adds Andriy Yakovlev.

- I think that this initiative was difficult to authorities because of its conflict with international conflict with its conflict Human rights, but it is not too right - to ignore the difficult situation in which our prisoners of war are due to torture and open abuse of the Russian Federation over all their human rights. , and look for non -standard mechanisms for the return of Ukrainians. " There is no other question that there is no mechanism that would allow civilians.

And this is a separate problem. Ukraine cannot click on the Russian Federation on its own to return its citizens. And they will hardly be interested in collaborators, because even Yusov noted that "most of them were not very needed, and here they hope that they would pay attention to them, they will be heard, they will be taken away.

" The issue of the return of civilians could be addressed by an international platform for the release of civilians illegally detained by the Russian Federation, which is guarded by the Ombudsman, but from February it is not heard about its work. Also, no decision, except for calling, was made during a peace summit in Switzerland.
