Its unit operated in the Kherson direction and was temporarily located in Nikolaev. According to the investigation, on September 13, 2022, Andrei R. arbitrarily left the place of service in Nikolaev. At the court hearing, he said that he was injured during the help of a wounded soldier, after which the commander denied him.

As a result, he left the place of service and went to a doctor in Odessa, where he made magnetic resonance imaging (MRI) of the knee joints. The MRI showed a break in the knee joints of Andrew R. The serviceman sent a photocopy of the results of the MRI to the command of his military unit, but did not receive the response from the command. In court, Andrei R. pleaded guilty and repented. In doing so, he expressed his desire to continue his military service.

In addition, the military noted that he is contraindicated in considerable physical activity, and in the future he may need medical intervention. After studying the case file, the court took into account the repentance and confession of a crime by Andrew R. as a result, the court applied the provisions of Article 69 (1) of the Criminal Code, which provides for the possibility of a softer punishment. The court also took into account the fact of documented injury to Andrew R.

and his responsibility for a minor child. As a result, the court decided to impose Andriy R. punishment in the form of detention in a disciplinary battalion for two years, instead of imprisonment.
