For ignition of hatred punishment, threats to the military - will not be brought to court: that threatens Irina Farion

The SBU opened criminal proceedings under four articles against Irina Farion, after her statements to the servicemen. Whether investigators will be able to bring the case to court, the focus asked the lawyer. Following the scandalous statements of the exnaissance and philologist, Irina Farion, who stated that she did not consider Russian -speaking servicemen of the Armed Forces of Ukraine, the SBU opened criminal proceedings under several articles of the Criminal Code of Ukraine.

Namely: the SBU has appointed a number of expertise for statements and publications of Farion. In particular, according to the materials of the investigation, in an interview, the People's Deputy of Ukraine of the 7th convocation stated that it categorically does not accept Russian-speaking servicemen of the Armed Forces and cannot call them Ukrainians. This caused a wave of indignation among Ukrainian defenders and society as a whole.

In addition, the Associate Professor posted a message on social networks with words of support from a pro -Ukrainian student who lives in the territory of the temporarily occupied Crimea. The message listed the sender's personal information, which is why the student was pursued by Russian special services. Farion herself has not yet commented on criminal proceedings. In her Telegram channel, she continues to publish a message from Ukrainians who send her support for support.

According to lawyer Yevgeny Zuranzhi, the statement of Farion to the Russian -speaking servicemen of the Armed Forces, whom she does not consider Ukrainian, falls under the article 161 of the Criminal Code of Ukraine. It provides criminal liability for deliberate and purposeful ignition of hatred, as well as a direct or indirect restriction of rights under a number of features, in particular - a language issue.

"I listened to her speech and I can say that it is possible to send the case to court under Article 161 in this case, since the investigator has a video [an interview in which Irina Farion speaks of Russian -speaking military personnel of the Armed Forces]. She offended the military who do not speak Ukrainian. But Article 435-1-a threat to servicemen, here it is more difficult to prove here, because we did not hear direct threats, "-says focus Zurvja.

The lawyer notes that in the history with the dissemination of personal information of a pro -Ukrainian student living in the territory of the temporarily occupied Crimea, Irina Farion can also be prosecuted. "Yes, she violated Article 163 of the Criminal Code of Ukraine - a violation of the secrecy of correspondence. The law prohibits the spread of personal correspondence and data of the sender: name, surname. As for the last article - it is difficult to say here. They want to prove.

We need to see what will be incriminated", " - notes Zurna. The expert adds that for each article separately conduct a pre -trial investigation. After the SBU has suspected, the process can last up to six months. It will only take one to two months for the examination. "There will be a political question - or not not. She is a public person, and will decide in the process," the lawyer sums up.

We will remind, after the scandalous statements of Irina Farion to the military personnel of the Armed Forces, the deputy commander of the 3rd OSHBD Maxim Zhorin stressed that the exnardepka has no right to offend no unit of the Armed Forces, and it is time for law enforcement to pay attention to the activity of the Associate Professor. It is known that during the USSR, Farion also dealt with a language issue.
