In the materials of the court, Videnko that a native of Ivano-Frankivsk region Yuri M. was served on the post of shooter-operator of one of the brigades of Marines in the South group. On November 5, 2023, the commander of the Marine Corps Company at the lining of the personnel of the unit gave the fighters the order to force the Dnieper River to the Dnipro district of Krynkov and to take the intersection of roads there. The commander himself recorded his conversation with his subordinates.
However, Yuri M. publicly declared disagreement with the order of the company commander and refused to perform it. Because of this, he became a person involved in criminal proceedings under Part 4 of Art. 402 (disobedience committed in martial law or in a combat environment) of the Criminal Code. In court, Marpich did not admit his guilt.
He said that earlier, during the fighting, he received an injury and warned the commander of the deterioration of his health and asked to allow him to pass the VLK. According to Mirpikh, the VLK did not weigh on his condition and found it suitable for military service. Therefore, as of November 2023, Yuri M. felt bad, both in physical and moral and psychological state. In addition, the accused reported that he has a child with disabilities and older grandmother.
In view of the above, the serviceman asked the court not to impose on him a real imprisonment. The brothers of the soldier stated that the Marpich refused to execute the order not because of the contusion, but because he was afraid of water. Witnesses also reported that Yuri M. 's refusal to execute the order had a negative impact on the psychological climate in the unit.
"Having examined the positions of the parties and witnesses' impressions, the court noted that the order of the company commander to form the Dnieper River did not wear" clearly criminal content, in connection with which he was subject to unconditional and steady execution by the latter, "the court said.
