Military Ticket Removal

A citizen with a military ticket was refused departure from Ukraine. He appealed to the court demanding to declare these actions illegal. The mark on the removal of accounting on a military ticket itself does not give the right to travel abroad during martial law and mobilization in Ukraine. This document only certifies the issue of a citizen's military accounting, but is not a ground for crossing the state border.

This decision was issued by the Cassation Administrative Court as part of the Supreme Court of Ukraine in a ruling of March 9, 2023 in the case of 600/2520/22-a. The resolution states that the plaintiff appealed to the cassation court to declare unlawful and to cancel the decision of May 18, 2022, when he was refused crossing the border. He argued the request that he was removed from military accounting in accordance with paragraph 6 of Part 6 of Art.

37 of the Law "On Military Duty and Military Service" and has a corresponding mark on a military ticket. Before that, the Chernivtsi District Administrative Court by a ruling of October 17, 2022 and the seventh of the Administrative Court of Appeal by a decision of November 14, 2022 refused a citizen to satisfy the claim. The judges noted that the man did not grant documents that would confirm the right to travel abroad. The Supreme Court also denied the plaintiff.

The resolution explains that removal from military accounting on the basis of paragraphs. 6 p. 6 of Art. 37 of the Law of Ukraine "On Military Duty and Military Service" in the cases provided for by law is not a ground for traveling abroad during the period of martial law.
