He stressed that the National Assembly of France supported the creation of the tribunal, and the French Foreign Ministry officially stated that they began participating in consultations on liability for committing a crime of aggression against Ukraine. In addition, members of the British Parliament appealed to the Prime Minister of the United Kingdom. The draft resolutions on the support of the Special Tribunal to the House of Representatives and the Bundestag were submitted.
“There are several guilty all crimes committed in Ukraine. On the one hand, it is a direct executor - a Russian soldier who came to the Ukrainian land to kill, or the operator of the launcher of the Russian rocket. On the other hand, those people who committed a key, primordial crime - a crime of aggression. We have the answers to both questions: how to hold the direct perpetrators of these terrible crimes and those who have solved aggression.
But in order to prevail in the world order and international law, we need the help of countries in the world, ”said Andrei Smirnov. The Deputy Head of the Presidential Office stated: the crime of aggression has specific grounds for jurisdiction, individual from other crimes defined in the Roman Statute of the International Criminal Court, such as military crimes, humanity crimes and genocide.
The jurisdiction of this court in the part of the investigation and liable for the crime of aggression is not subject to non -participants of the International Criminal Court, regardless of whether they are a victim or aggressor, except in the case of a UN Security Council.
Considering the fact that Russia has the right to veto the UN Council's decision, such an appeal is not just difficult to implement - it is impossible, and, accordingly, in this case, the International Criminal Court will not have a proper jurisdiction in investigating the crime of aggression.
“In fact, we would like to take advantage of all the jurisdictions of the International Criminal Court, but confirmation of the problem is the fact that in eight months of the escalation of the war we have not seen the registered proceedings about the crime of aggression. And this is definitely not the guilt of the ISS. We are grateful to the ICS for the continuous work they do with the documentation and investigation of the crime of genocide, crimes against humanity, war crimes.
But there is a risk that the crime of aggression will remain unpunished. And even if Ukraine rapidly ratifies the Roman Statute, we objectively understand that Russia will never do it. Therefore, this will make it impossible to investigate within the mandate of the International Criminal Court, ”Andrei Smirnov stressed.
The Ambassador of Special Generals of the Ministry of Foreign Affairs Anton Korinevich at a press conference noted that our country continues to work within the UN in order to lay a basis for liability for committing a crime of aggression against Ukraine.
Also, he said, the position of all key stakeholders that support the creation of a special tribunal and consider its establishment as a necessary element of a system of responsibility for serious violations of international law committed by Russia and its military in Ukraine is extremely important.
