The defendant's representative did not admit the fault of the company, explaining that the stay of the tanker in the sea beyond the navigation dates is associated with a failure of the schedule of work of the ship. According to Kama Shiping, on November 18, the tanker stood an anchor near the port of the Caucasus, and only on December 3, the port of Porta put Volgoneft-212 in a queue for unloading. The process was delayed due to the accumulation of vessels.
The tanker had no opportunity to leave the sea, since the permission to move to the river port outside the navigation could only be obtained after unloading the fuel oil. "When the storm began, the captain of the vessel asked to give shelter, but all the safe places were occupied," Kama Shiping explained in court.
