Yes, Alisher Valeyev filed a lawsuit in which he asked the court to recognize the SBU's actions on the preparation of documents and appeal to the Ministry of Culture and Information Policy of Ukraine as unlawful. He also asked to cancel the Ministry of Culture's order to update the list of persons who threatened national security, on the basis of the SBU certificate.
During the consideration of the case, Morgenstern stated that he was unknown whether the decision was made to ban his entry into Ukraine by the SBU. The Court noted that compiling a list of persons who threatened national security does not mean automatic rejection of entry into the country or in issuing permits for the organization of concerts, etc. The court also took into account the information from the SBU that the agency did not make a decision to prohibit Morgensterne's entry into Ukraine.
"The court also takes into account the information provided by the Security Service of Ukraine that the decision of Ukraine to prohibit the entry into Ukraine by a Russian citizen was not made," the court decision reads. In October 2023, the Kyiv District Administrative Court rejected Morgenstern's claim against the SBU and the Ministry of Culture. It should be noted that at the time of publication of the material in the SBU did not comment on the situation.
In September 2021, the SBU reported that the speeches of the Russian rapper Alisher Valeyev, known as Morgenstern, were banned in Ukraine, as the contractor was included in the list of persons who pose a threat to Ukraine's national security. Morgenstern himself stated that he was sorry that he could not come with touring in Ukraine, where, according to him, "the most fragile concerts" in the artist's life were held.
