The Verkhovna Rada approved a law in the first reading that allows men to book men at critical enterprises, even if they are not registered in the CCC or wanted. Document No. 13335 gives enterprises a defense-industrial complex the right for 45 days to book employees who do not have or improperly issued military-accounting documents. This also applies to those who have not specified personal data or are not on military registration.
The bill was supported by 283 deputies, with the time of submission of amendments for the second reading. Booking for such employees is limited to 45 calendar days from the moment of conclusion of an employment contract and is provided only once a year. Earlier, the Ministry of Defense of Ukraine opposed the bill, noting that giving advantages to violators of mobilization legislation is unacceptable, writes "Forensic law".
However, the Verkhovna Rada Committee on National Security recommended that the document be adopted in the first reading, submitting its conclusion later for the remarks of the Ministry of Defense. Herman Smetanin, CEO of the Ukrainian Defense Industry, supported the adoption of the bill in the first reading. According to him, the bill simplifies official employment, allowing to regulate issues with military accounting documents.
Booking is provided once a year for one person, and in case of failure to comply with conditions, it is canceled, which provides transparency and validity of the mechanism. Also, in his opinion, the adoption of the Law No. 13335 will contribute to the faster filling in the personnel reserve, in particular by attracting Ukrainians who are abroad.
According to the lawyer and the senior partner of the law firm Kravets and partners Rostislav Kravets, the need for such law arose due to problems with the booking of workers who did not update their data in the territorial centers of staffing or considered themselves excluded from military accounting. Often there have been cases where such persons were unexpectedly renewed on the register, they were wanted, which actually made them violators.
This created obstacles to working in the real sector of the economy, because businesses could not officially book such specialists. The bill proposes a decision: businesses can book employees for 45 calendar days during which they should regulate military accounting issues, undergo a military medical commission (VLK) or solve the search problems. After that, the employee may continue to work with the current booking. Booking is provided only once a year, which provides transparency and control.
However, the tailor draws attention to the risks associated with the unfair work of the CCC. “It is likely that 45 days will not be enough because of the delay or deliberate failure of data by representatives of the CCC. In this case, the employee may lose the reservation, be released and immediately mobilized.
To prevent this, it is necessary for the General Staff and the Command of Land Forces to strengthen the control over the activities of the CCC, ensuring the timely introduction of data of the persons who have eliminated the violation, " - says the focus lawyer.
