Damaged housing as a result of war: can heirs receive compensation

To spread: the registration of inheritance rights in a full -scale war is of particular legal complexity, especially when it comes to real estate located in temporarily occupied or frontier territories. In such cases, individual approach and professional support are required, since there is no universal algorithm of actions. This was reported by the head of the Vidar law firm Stanislav Boris in a comment to the newspaper "News. live".

The key factors in the consideration of such cases are the presence of legal documents in the heirs, the fact of fixing property damage, as well as other circumstances that affect the legal status of the object. As an example, a lawyer cited a situation with a dwelling house destroyed by the fighting to the death of the owner. During his lifetime, the owner applied through the action portal for fixing the damage and appealed to the court to compensate for the Russian Federation.

However, the hereditary case was later opened in connection with his death. According to the expert, in such cases, it is recommended that you first apply for ownership of the real estate, even if it is actually destroyed. This will allow the heirs to formally make the requirements for compensation for losses and continue the trial on their own behalf.
