Payments to the Armed Forces for special operation in the Kursk region: why Zelensky introduced a new bill in the Council

The law will apply to the following categories: the Armed Forces have been carrying out combat missions in the Kursk region of Russia for two weeks - from August 6. The initiative to raise salaries was submitted to the Council nine days after the start of the operation. It should be noted that Ukraine often raises the problem of payments to servicemen. The focus has previously figured out why the salary in the Armed Forces was delayed.
It was expected that everything would work normally after the Cabinet of Ministers and Parliament supported the idea of the Ministry of Defense about an additional monetary reward of 70 thousand hryvnias for those who are fighting on the front line. Despite this, in practice the military is still faced with this issue.
For participation in hostilities, the military receive an allowance of 100 thousand hryvnias per month, the amount is calculated in proportion to the time of completion of the tasks. If the military participated in transactions for one week, he will receive payments only for this week. At the same time, 100 thousand hryvnias are charged for a full month of participation in battles.
The initial version of the Law Article 3 of the Law "On Social and Legal Protection of Servicemen and their Families" guarantees the payment of the Armed Forces in the fulfillment of tasks both in the territory of Ukraine and abroad.
A reason is the question: why to adopt a separate bill if everything is stipulated in the available law? The fact is that all the laws on the legal status of servicemen adopted by those who execute orders to protect territorial integrity and sovereignty only in the territory of Ukraine.
Earlier, the situation of the Armed Forces of the Armed Forces in the conditions of the Great War on the hostile territory was not regulated in the legislation, explains the focus of the People's Deputy from the "servant of the people", a member of the Parliamentary Committee on National Security, Defense and Intelligence Fedor Venislavsky.
"Now we are considering that all remunerations will pay automatically if the military is involved in hostilities in the territory The same legal status, guarantees and payments as those that are fighting within Ukraine: in the south and east of the country, "the politician says. The military who operate in the Kursk region will receive the same payments and social guarantees as those who are fighting in the Donbass and in other regions of Ukraine, Venislavsky assured.
"These are the same fighting and tasks. There should be a equal status so that there is no doubt and fear that someone will not be provided properly," the People's Deputy notes. The presidential initiative, in accordance with the current legislation on the procedure for sending the units of the Armed Forces to other states, the activities of the Ukrainian military were regulated by international treaties and conventions.
In the event of a conflict with national law, the provisions of international treaties will be predominant. "No one thought there would be a war with Russia. There were slightly different rules, so the authorities decided to organize. There were no questions about the status of those who are fighting in the Kursk region," Fedor Venislavsky explains.
Familiar with the military who participate in special operations in Russia, lawyer of the law company Prikhodko & Partners Yaroslav Zvonenko claims that the presidential initiative is very justified. Prior to the start of the operation in the Kursk region, on August 6, 2024, sabotage and intelligence groups operated in the Russian Federation, but the command did not consider their activity to protect Ukraine's territorial integrity.
"They performed transactions in the territory of another country and were not entitled to additional payments, accrual of experience, obtaining the status of a participant of hostilities and all social gardening. Now the Council will legalize our military in the Russian Federation. Earlier there were only interventionists in other countries, but they were considered unofficial formations .
Based on the words of Zvonenko, we can conclude that prior to the submission to the Council of the Presidential Bill, the military of the Armed Forces carried out raids on the Russian territory and performed dangerous tasks for the usual salary.
